Terms of Service

These Terms of Service ("Terms") govern your access to and use of Tayibnb ("Tayibnb", "we", "us", or "our"), including our website and any related services (collectively, the "Platform"). By creating an account, listing a property, or booking a stay through the Platform, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.

1. Eligibility and Accounts

You must be at least 18 years old and capable of forming a binding contract to use the Platform. Accounts are created and authenticated through our identity provider. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account, and you agree to provide accurate, current, and complete information when creating your profile.

2. The Platform Is a Marketplace

Tayibnb provides a platform that connects members who wish to list accommodations ("Hosts") with members who wish to book those accommodations ("Guests"). Unless explicitly stated otherwise, Tayibnb is not a party to any agreement between Hosts and Guests, does not own, manage, or control any listed property, and is not acting as an insurer, travel agent, or real estate broker. Hosts are solely responsible for the accuracy of their listings and for complying with all laws applicable to short-term rentals in their area, including licensing, zoning, health and safety, and tax obligations.

3. Listings and Amenity Information

Hosts are solely responsible for the content of their listings, including descriptions, photos, pricing, house rules, and any amenity or suitability information (including "Muslim-friendly" designations such as the presence of a prayer space, halal-friendly kitchen facilities, or qibla direction information). Tayibnb does not independently verify these claims. Guests should confirm any amenity or suitability details directly with the Host before booking if they are material to their decision.

4. Bookings, Pricing, and Payments

When you submit a booking request, a reservation is created in a pending state and is only confirmed once payment has been successfully processed. All payments are processed by our third-party payment processor, Stripe. Tayibnb does not store your full payment card details. Prices displayed at checkout include the nightly rate, any cleaning fee, and a service fee charged by Tayibnb for use of the Platform. Pending bookings that are not paid within the displayed time window are automatically released.

5. Cancellations and Refunds

Cancellation and refund eligibility are described in our Cancellation & Refund Policy, which forms part of these Terms. Bookings cannot be cancelled by a Guest once check-in has begun.

6. Host Payouts

Hosts receive payouts for completed bookings through Stripe Connect, net of Tayibnb's service fee. Hosts must complete Stripe's identity verification ("onboarding") before payouts can be released. Payout timing and amounts are calculated automatically based on the booking's confirmed total and check-in date.

7. Reviews

Guests who complete a stay may leave a public review and rating. Reviews must reflect a genuine experience and must not contain unlawful, defamatory, harassing, or fraudulent content. We may remove reviews that violate these Terms.

8. Prohibited Conduct

You agree not to:

• Use the Platform for any unlawful purpose or in violation of any applicable local, national, or international law;
• Provide false, misleading, or fraudulent information in a listing, booking, review, or profile;
• Circumvent the Platform's payment system to avoid fees;
• Attempt to interfere with, compromise, or gain unauthorized access to the Platform, other accounts, or our systems;
• Harass, discriminate against, or discriminate based on race, religion, national origin, disability, sex, gender identity, sexual orientation, or age.

9. Third-Party Services

The Platform relies on third-party services to operate, including identity and authentication, payment processing, database and file storage, transactional email delivery, and error monitoring. Your use of the Platform may also be subject to the terms and privacy policies of those providers. We are not responsible for the independent acts or omissions of third-party service providers.

10. Disclaimers

The Platform is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the Platform will be uninterrupted, secure, or error-free, or that any listing is accurate, safe, or suitable for your needs.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Tayibnb and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or in connection with your use of the Platform, any booking, or any interaction between Hosts and Guests. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

12. Indemnification

You agree to indemnify and hold harmless Tayibnb from and against any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Platform, your listings, your bookings, or your violation of these Terms or applicable law.

13. Suspension and Termination

We may suspend or terminate your access to the Platform at any time, with or without notice, if we believe you have violated these Terms, applicable law, or pose a risk to other users or to the Platform. Confirmed bookings already paid for at the time of suspension will be handled in accordance with our Cancellation & Refund Policy.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above and, where appropriate, provide additional notice. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.

15. Governing Law and Disputes

These Terms are governed by the laws of France, without regard to conflict-of-law principles. Subject to any mandatory consumer protection rules of your country of residence, any dispute arising out of or relating to these Terms or the Platform shall be subject to the exclusive jurisdiction of the competent courts of France.
